Right of business or carrier or trade and right of goodwill are two distinct financial rights that have been recognized by our legislator, owning intangible subject matters, so these subject matters can be examined under the umbrella of intellectual property as long as they originate from intellectual efforts and endeavors of a merchant. In This article we are to determine the framework of Right of business or carrier or trade provided in lesser and lessee act 1976 and the framework of Right goodwill provided in lesser and lessee act 1996 to finally draw the status of these rights in intellectual property law and to show though Right of business or carrier or trade and right of goodwill are legally different, their subject matter can be an intellectual creation.
